Weather Conditions and Safety Cancellation Policy


1.⁠ ⁠Conditions Constituting “Bad Weather” or “Dangerous Conditions”

For the purposes of this cancellation and rescheduling policy, “Bad Weather” or “Dangerous Conditions” means that, in the reasonable professional judgement of the Company, any one or more of the following conditions applies to the planned trip within the Bay of Palma:

The safety of our clients, crew and vessel is our primary consideration. Weather and sea conditions are therefore assessed by the Company before and, where necessary, during each scheduled trip.

1.⁠ ⁠Sustained wind: sustained wind speeds of more than 25 knots within the Bay of Palma; and/or

2.⁠ ⁠Wave height: significant wave conditions or wave height of more than 1.0 metre within the area in which the trip is intended to operate; and/or

3.⁠ ⁠AEMET weather warning: an Orange or Red weather warning issued by AEMET (Agencia Estatal de Meteorología) that specifically applies to the relevant area of the Bay of Palma and is active during any part of the scheduled trip.

The Company may also cancel or modify a trip where, notwithstanding the above thresholds not being met, the master/skipper reasonably determines that the actual or forecast conditions present an unacceptable safety risk to clients, crew or the vessel.


2.⁠ ⁠Refund or Rescheduling

Where the Company cancels a trip because of Bad Weather or Dangerous Conditions as defined above, the client will be offered, subject to availability:

•⁠  ⁠a rescheduling of the trip to an alternative date; or

•⁠  ⁠a full refund of the amount paid for the cancelled trip where rescheduling is not possible or the client elects to receive a refund.

The Company will make reasonable efforts to provide notice of any weather-related cancellation as early as practicable.


3.⁠ ⁠Normal or Short-Duration Weather Conditions

Ordinary weather conditions do not, by themselves, constitute grounds for a weather-related refund or rescheduling.

In particular, light or moderate rain, isolated showers, brief rain showers, short-duration squalls, temporary gusts, cloud cover, or other transient weather conditions that pass through the Bay of Palma without resulting in the conditions specified above will not automatically entitle the client to a refund or rescheduling.

For example, a brief rain shower or short squall that passes through the Bay of Palma, after which conditions return to an acceptable level for the planned trip, will not constitute Bad Weather or Dangerous Conditions under this policy solely because the event occurred.


4.⁠ ⁠Authority of the Master/Skipper

The final decision as to whether a trip can safely proceed rests with the master/skipper of the vessel. Weather forecasts, AEMET warnings, observed conditions and the characteristics of the vessel and planned route may all be taken into consideration.

The Company reserves the right to delay, shorten, modify, alter the route of, or cancel a trip where the master/skipper considers this necessary for safety, even where the specific numerical thresholds above have not been reached.

No client is entitled to a refund solely because they consider the weather undesirable or because conditions differ from their personal preference, provided that the trip can reasonably and safely proceed.
